Thomas was a coachbuilder in 1851, in Newton Abbot, Devon.
See Western Times - Saturday 13 September 1851 for an account of Pascoe, wheelwright, covering his brother in law Thomas Ruby's forgery and Thomas was believed to have departed for Quebec on the Queen Victoria.
The Western Times 29 Nov 1856 reported on the case of Shapley vs Ruby. Plaintiff is the assistant overseer of Torquay, and lives at Abbotskerswell. The action was brought to recover £2, money lent. Mr. Francis appeared tor the plaintiff. The following is the evidence : Thomas Shapley had a son apprenticed to a Mr. Pascoe, son-in-law of defendant, and was to pay £14 premium, half at starting and the remainder when half the time had been passed. On the 3rd June he received a note from Pascoe requesting the 1567 as a favour, (previous to Midsummer when it was due), for which he would give £1 a discount. He did not send it, however, as he was suspicious. On the 29th June defendant brought another note from Mrs. Pascoe, requesting the money, or a portion of it, only £2 or £3, and defendant brought it. He wrote a check for two pounds, but said he did not consider he owed Mr. Pascoe anything. for he had neglected to bring on his son as he ought, and added " if I let you have the money I lend to you and shall expect it from you again," to which defendant replied very well. Pascoe had left the county before the check was given, and had not been seen since, the business and stock had all been sold by defendant, who had pocketed the proceeds. Mary Shapley corroborated a part of her husband's evidence, and said defendant had admitted to her on Thursday that had sent the £2 to Newton for goods.
Thomas Ruby was sent by Mrs. Pascoe for the money on the 27th June. Mrs. Pascoe told him there was £7 due, and asked him to get what could it. Went and saw Shapley, who said he had money, but ultimately wrote check and gave to witness. Nothing was said about plaintiff's sou not being properly treated, not a word was said about lending him the money, or he should have returned the check again. Did not know what was the check till at some distance from the house, when he saw 'twas for £2; took it back to Mrs. Pascoe, who sent to Newton for coal and iron, which was used the trade. Witness sold the goods and stock of Pascoe about five weeks after, as he held a bill of sale on it, and paid himself as far as he could.
George Ruby, baker, of Abbotskerswell, was at work in a field, when plaintiff came him and asked him to make up the two—cases that of Rendell v Shapley, and the present. Plaintiff bought some plank at Pascoe's sale, which he tried to set against the £2, but the auctioneer entered action tor the money, and he had paid it, and plaintiff told him (witness) that if Rendell summoned him for the plank would sue witness's father for the £2, swear he lent it him. His Honour considered it very extraordinary that plaintiff should offer lend the £2 to defendant who never asked for it, and the attempt of plaintiff recover the money by purchase of planks was clear to him that he considered it Pascoe's affair; he would, therefore, give judgment of non-suit..
