Atherton in his lifetime delivered to Anthony Mawde of Helthwayhill £100 to be safely kept for Atherton's use, and to be paid to him or his assigns on demand, and by his will gave all his goods, etc. not otherwise bequeathed (and therefore including the £100) to the said Robert & John Rither, and made them executors. John has since died, but Robert is alive and still under 21. The plaintiff, as adminstrator, demanded the £100, but Mawde refused to repay it. The plaintiff, about two years ago, complained before the Council of the North at York, when Mawde appeared, and falsely swore that the £100 was a gift. He asked for a supoena against Mawde for perjury. Mawde demurred, on the ground that the cause of complaint arose before the Council of York, and could therefore be best tried there..

John Ryther was born circa 1175. He was the son of William Ryther. They was listed on a deed dated between 1192 and 1194 as a witness. William de Riha (brother & heir of William) in 1192 or 1194 gave to Nun Appleton priory a yearly rent of 5 marks for the church of Ryther; and witnessed by John, Gilbert & Hugh, sons of William de Riha, evidently the grantor's sons. The first witness Ralph, archdeacon of Hereford, occurs as a justice of Yorkshire in 1192 and 1194. Early in the reign of Richard I, a controversy about the church of Ryther had ended by a release by the prioress of Nun Appleton of all claim to the advowson, receiving a yearly rent of 5 marks from William de Ryther. The controversy had probably arisen on the succession of William de Ryther the younger, and the charter quoted in the text presumably confirmed the arrangement then made.

In Easter term 1212 William put in his place Gilbert de Rie, described as his son & heir, in a plea of dower brought against him by Lecia widow of John de Ria (showing him to have died in his father's lifetime).
Speight states: A third part of the the manor of Ryther was claimed in dower by Lecia, late wife of John de Rie or Ryther, and this lady on her husband's decease had to prove her just dues against the heirs or successors of her husband by entering a writ in the form of a fine at the King's Court at York before the justices in Eyre on 1 July 1212, whereby she yielded all her rights to a third part of the manor of Rie, with apperturnances to William de Rie (no relationship given) on payment to her by the said William of 15 marks of silver. The said William is represented in this suit by Gilbert de Rie, no doubt the one mentioned in the grant of land at Ryther to the canons of Bolton....

Quarterly, Gascoigne and Mowbray a label of 3 points ar., a border gobony. A Knight kneeling with Gascoigne & Mowbray with a border gobony quarterly on his brest, his wife by him with Clarell and Gascoigne impaled, 7 sons and 3 daughters. Under all: Orate [pro] Willelmo Gascoigne et Margarea, uxore ejus, et anima [?] ...

Reciting that 2. were trustees under a lease for 31 years from Edmond Clough deceased father of 1. of the house and most of the demesnes in Thorpe, and had wardship of Gervaise (Edmond's eldest son) & of the said Maior, (Gervaise's brother and heir) and that they were to receive the issues and profits of the lands and dispose of the personal estate of Edmond upon certain trusts; that they had received £2058. 8s. 4¼d. and had disbursed £2900. 5s. 10½¼d. according to a schedule annexed; [missing] that they were bound to Dame Margaret Ellis (late wife of Edmond) by Bond 9 Feb. 1627 in £200 to secure her £30 p.a. for life in lieu of dower.
It was witnessed that Maior Clough acknowledged that he had received of the trustees their accounts and in consideration of their surrender of the lease of the house &c. (22 years yet in being) and for their security he bargained and sold to them the following closes in Thorp or Thorpstapleton:-
The Milnefield, East field, Ellis close, the Ings, Menscroft, the horse Sawterlands and Kitchingman's little close;
Proviso that if 1. indemnified the trustees against the following claims this assurance should be void:- the bond to Dame Margaret; the claims of Sir Ferdinando Leigh re £500 given to Lady Anne Leigh his late wife deceased by Edmond Clough her father; all claims of Dame Margaret under Edmond's will; all suits now depending between the trustees and the executors of John Cartwright of Bryam gent. or of John Goodhand of Ardington re Edmond's debts.

He was presumably the source of the information in the Visitation of Yorkshire when he was described as aged 74 on 4 April 1666, and his son John was 35 and grandson John aged 6.
