His parentage is assumed. He could be the son of Peter bp 3 Jan 1785 at Tullnessle? or of Andrew 1784?. He was the son of Peter Emslie and Mary Law. James Emslie was a witness at the christening of James Emslie on 11 January 1822 in Premnay, Aberdeenshire. James Emslie was a witness at the christening of Mary Emslie on 24 November 1823 in Premnay, Aberdeenshire.
     James Emslie married Barbara Mitchell on 20 September 1824 in Premnay, Aberdeenshire. James Emslie was a witness at the christening of Peter Emslie on 15 October 1825 in Premnay, Aberdeenshire. James Emslie was a witness at the christening of Janet Emslie on 28 January 1829 in Premnay, Aberdeenshire. James farmer of 80 acres in Backbrae, Premnay, between 1841 and 1861.
     James Emslie and Barbara Mitchell appeared on the 1841 census in Premnay. James Emslie aged 55, farmer, Barbara aged 45, James 14, Mary 12, William 12, Alex 10, Ann 8, Barbara 6, John & George aged 4, Isabel 2, and Robert aged 5 months. In the next household but same building are Peter Emslie aged 25, ag. lab., with Alex Gray, Ag. lab, 35; William Davidson, aged 15, ag. lab., and Margaret Meldrum aged 15, F.S.

James Emslie, aged 65, farmer of 80 acres, born at Tullynessle with his wife Barbara aged 55, born Kinnethmont, William aged 21, Alexander aged 19, both ag. labs, Ann aged 17 & Barbara aged 15, both house servants, John aged 13, ag. lab, George 13, Isabel 11, & Robert 9, all scholars, all born at Premnay.
     James Emslie and Barbara Mitchell appeared on the 1861 census in Premnay. James Emslie, 75, head, born Tullynessle, farmer of 80 acres employing 4 labourers, with his wife Barabara 63, born Kinethmont, and children Alexander 28, born Premnay, Ann 25, ditto, George 22, ditto, Isobel 20, ditto, Ann 1, grand daughter, born Premnay, and John Watt aged 13 and George Anderson aged 15, farm servants.
     James Emslie made a will dated 8 November 1861 in Premnay. He mentions his wife Barbara (Mitchell) and his children: James Emslie, Mary Mitchell or Emslie, wife of Robert MItchell of Wellside, William Emslie, now or lately in America, Alexander Emslie, his son and sole executor, Anne Emslie, John Emslie, George Emslie & Isobel Emslie, all presently residing here and Robert Emslie, carpenter. Alex Binnerm, farmservant was a witness.
     James died on 19 November 1861 in Backbrae, Premnay, Aberdeenshire, aged 76. James Emslie, farmer, married to Barbara m.s. Mitchell; aged 75, son of Peter Emslie, farmer (deceased) & Mary? Emslie, m.s. Law (deceased), of gradual decay. The informant was Alexr? Emslie, son, present at death.
     His will was proved on 31 December 1861 at Aberdeen. James Emslie, farmer at Backbrae in the parish of Premnay (or 26 Nov?).
